DEBT RESOLUTION and CONSUMER LAW

Resolve your debt issues once and for all with effective legal representation from me. I can help you navigate the sometimes complicated process of resolving debt through my years of experience in consumer law and credit card debt. The main two debts I see are credit card debt and mortgage debt.

In some instances your debt can be negotiated down to a reasonable level and payments made over time. Other times it may be necessary to take legal action.

Violations of the Fair Debt Collection Practices Act (FDCPA)

You hear on TV or radio from these Debt Relief Companies that advertise "if you owe more than $10,000 you have the right to settle your debt for less." This is a scam. The fact is the credit card companies are under no obligation to settle that debt for less than what they say you may owe. You can always try and settle your debt no matter how much it is. And its up to the credit card company and you. There is NO law requiring them to settle the debt because it's over $10,000.

Don't fall victim to these scam artist. They say it's a free service but in the end they want your money.

The real secret that the credit card companies don't want you to know is that more likely than not they have sold your debt to a third party debt collector. That debt collector buys debt in bulk. Thousands and thousands at a time. When that debt is sold, it is sold "AS IS" with no guarantee as to whether the debt is valid or not. The debt collector is simply buying paper and once that paper leaves the original creditor it becomes "HEARSAY" and is inadmissible in Court. That's what the credit card companies or shall we say third party debt collectors don't want you to know. The SECRET that they don't want you to know is they can't prove the debt in Court. I can show you how to beat the case almost every time.

So If you are being sued or threaten with suit by a third party debt collector they may be committing violations of the FDCPA. This is most common in credit card debt cases. I can show you how to beat the case even if you owe the debt and may even have a potential case against the third party debt collector for violations of the FDCPA.

I have successfully sued Midland Funding LLC., Portfolio Recovery Associates, LVNV and other third party debt collectors for violation of the FDCPA and recovered money damages for my clients. If you find yourself in this type of situation don't go at it alone. Give me a call. (334-269-9700)
